Terms of Service

1. Agreement to Terms

By accessing or using the Fluxt Tech BSS/OSS platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Fluxt Tech provides a cloud-based BSS/OSS platform for telecom service providers, including customer management, billing, order processing, inventory management, and related services.

3. Account Registration

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access
• You must be authorized to enter into this agreement on behalf of your organization

4. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for fraudulent purposes
• Resell or sublicense the Service without authorization
• Reverse engineer or decompile the platform

5. Subscription and Billing

• Subscription fees are charged based on your selected plan
• Fees are billed in advance on a recurring basis (monthly/annually)
• All fees are non-refundable except as required by law
• We may change pricing with 30 days’ notice
• You authorize us to charge your payment method for all fees
• Failure to pay may result in suspension or termination of service

6. Data and Privacy

• You retain ownership of all data you upload to the platform
• You grant us a license to process your data to provide the Service
• We implement security measures to protect your data
• You are responsible for backing up your data
• Our Privacy Policy governs how we collect and use information

7. Service Level and Uptime

We strive to maintain 99.9% uptime for the Service. Scheduled maintenance will be announced in advance. Service Level Agreements (SLAs) are defined in your specific subscription agreement.

8. Intellectual Property

• The Service and all related intellectual property are owned by Fluxt Tech
• These Terms do not transfer any ownership rights to you
• You may not use our trademarks without prior written permission
• You grant us the right to use your logo for marketing purposes

9. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the course of using the Service. This obligation survives termination of the agreement.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUXT TECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

12. Indemnification

You agree to indemnify and hold Fluxt Tech harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Term and Termination

• These Terms remain in effect until terminated by either party
• You may cancel your subscription at any time
• We may suspend or terminate your account for violations of these Terms
• Upon termination, you will lose access to the Service and your data
• We will provide a reasonable period for you to export your data

14. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We are not liable for any modifications or discontinuations.

15. Governing Law

These Terms are governed by the laws of India. Any disputes will be resolved in the courts of Delhi, India.

16. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or through the platform. Continued use of the Service constitutes acceptance of updated Terms.
